Can the First Amendment prevail against David Hester? Yep!

A judge refused to issue an injunction blocking A&E from continuing to shoot “Storage Wars,” according to E! News. The ruling is a stumbling block for former star David Hester, who is suing the network claiming that the show is rigged. According to the report, L.A. Superior Court Judge Michael Johnson also dismissed Hester’s charges that the show is rigged.

He ruled that stopping production of the show would violate the network’s First Amendment rights.

“It is well settled that television broadcast involves free speech, as well as production activities that advance or assist in the creation of a television program,” the judge said.

Hester has claimed that he was dropped from the show after exposing the show’s alleged practice of planting valuable items in storage facilities to increase the drama on the show.
