Gosselin’s attorney, former assistant U.S. Attorney Anthony F. List, tells TMZ he’s going to court to ask for primary physical custody, claiming that Kate has become “an absentee mom.”
Jon, who is currently paying Kate $20,000 a month in spousal support, will be asking for primary custody of the couple’s eight children and will also ask the judge to reverse the support obligation – forcing Kate to pay him an unspecified amount.
TMZ is also reporting that List expects to present Kate’s ‘DWTS’ stint as evidence that she does not spend enough quality time with the children.
KATE GOSSELIN RESPONDS:
“I am not willing to comment in public on the custody discussions regarding my children,” Gosselin says in a new statement. “What I will say is this: I am and always will be a mother first, but as a single working mom, I will do everything necessary to provide for my kids despite the opinions of others.”
The couple, who gained fame with their reality series, ‘Jon & Kate Plus 8′, were divorced last year.
